1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

2. Eligibility & Method of Entry. The zafu Jeans 911 Photo Contest (the “Contest”) is open to U.S. residents (excluding Puerto Rico), 18 years or older at the time of entry. Employees of zafu (or “Sponsor” as that term is defined below) and each of its respective affiliated companies, subsidiaries, and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with such employees, are not eligible. The Contest will begin at 12:01 a.m. (P.S.T.) on November 15th, 2006 and all Entries must be received by 11:59 p.m. (P.S.T.) on March 15th 2007 (the “Contest Period”). Enter by submitting a photo in either .jpg, or .gif format no more than 100kb file size to jeans911@zafu.com together with all of the required registration information, including (i) name, (ii) email, (iii) phone number, (iv) where and when photo was taken, and (v) a brief explanation of why you are submitting the photo (an “Entry,” and the submitter, an “Entrant”). The Jeans 911 Photo Contest is looking for Entries that illustrate a jean style disaster that Sponsor’s fit experts can comment on to describe what went wrong and what could have been done to avoid such a fashion mistake. All submissions will be reviewed by Sponsor and approximately once each business day (or as otherwise reasonably determined by Sponsor) Sponsor will select the Entries that best reflect jean style disasters.

Selected photos from Entries will be featured on the zafu blog at http://www.zafu.com/roller/page/blog and each Entry will be submitted to a vote by readers of the zafu blog. All Entries must be received no later than 11:59 p.m. (P.S.T.) on March 15th 2007 and all voting will end at 11:59 p.m. (P.S.T.) on March 31st 2007. Multiple Entries permitted per person, but an individual may only vote one time, and any attempt to artificially inflate a vote total (including, without limitation, through the use of scripts, proxies, automated tools or other means) may result in a disqualification of the Entry and the removal of the Entrant from consideration for any prizes. zafu will not be responsible for incomplete, lost, late, post-due, misdirected or illegible Entries or for failure to receive Entries due to transmission failures or technical failures of any kind, including, without limitation, undelivered email, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all Entries will be deemed to have been submitted by the name included in the required registration information submitted and shall be determined by Sponsor in its sole discretion. Sponsor reserves the right to disqualify any Entries by persons determined to be tampering with or abusing any aspect of the Contest.

3. Prizes; Odds; Winners. At the end of the Contest period, five winners will be determined based on the total number of legitimate votes cast by zafu blog readers. These five winners will each be eligible to receive a free jean featured on the www.zafu.com website at the time of the award (approximate retail value of the prize is $15 - $150, but in no event shall the prize value exceed $200). In addition, Sponsor will select a grand prize winner from the top five that Sponsor believes best reflects the fashion mistakes that can be made while wearing jeans to receive a one thousand dollar ($1,000) grand prize. Odds of winning depend on the number of eligible Entries received and votes cast. Winners will be notified by electronic mail or and/or telephone on or about April 15th, 2007. Return of prize notification as undeliverable may result in disqualification and an alternate winner may be selected. Winners may waive their right to receive prizes. Prizes are nonassignable and nontransferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value or provide a cash award substantially equivalent in prize value in lieu of any specific prize. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of postmark. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner. Except where prohibited, participation in the Contest constitutes entrant’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation or further compensation. 4. Agreement to Terms. By participating, entrants agree to be bound by these Official Rules and the decisions of the judges. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the Entries received before the termination date.

5. Submissions; Rights. By submitting an Entry, Entrant: (a) represents and warrants that the Entry is original, not previously published, and does not incorporate or include anything that is owned by any third party or would require the consent of any third party; (b) represents and warrants that the Entry does not violate any copyright, trademark, publicity right, privacy right or any other right of any third party; (c) automatically grants to Sponsor a royalty-free, non-exclusive, worldwide, irrevocable license to use, copy, adapt, reproduce, create derivative works from, modify, publish, edit, translate, distribute and display the Entry during the term of the promotion and in perpetuity, after which all such license rights shall terminate, and any rights that remain shall revert Entrant; and (d) agree that if the Entry is selected to receive a prize, that the Entry shall legally be considered a "work made for hire," with all rights therein, including, without limitation, the exclusive copyright, transferred to and being the property of Sponsor and to the extent the Entry cannot be considered a "work made for hire," Entrant irrevocably assigns to Sponsor, all right, title, and interest in and to the Entry (including, without limitation, the copyright) in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all legal uses thereof. By submitting an Entry, Entrant grants Sponsor and its affiliated companies the right, except where prohibited by law, to use Entrant’s name, likeness, picture, address (city and state), and Entry, for advertising and promotional purposes in promoting or publicizing Sponsor, and its products or services, without compensation unless required by law, and Entrant acknowledges that Entrant shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of Sponsor’s use or modification of any such information or the Entry. If Entrant does not want to or is unable to grant the foregoing release and rights, please do not enter the Contest.

6. Disclaimers; Miscellaneous. By entering, participants acknowledge and agree that the Sponsor and its respective corporate parents, subsidiaries, and affiliates, and the officers, employees and agents of each of them (collectively, the "Contest Entities") will not be liable for losses or injuries of any kind resulting from any participant's acceptance, possession, use and/or misuse of any prize(s), travel to or from any prize-related activity, participation in the Contest, printing, mailing or distribution errors, or any malfunctions of the telephone network, computer Internet system, computer dating mechanism, computer equipment, software, or any combination thereof. Without limiting the generality of the foregoing, the Contest Entities will not be responsible or liable for any injury or damage to any participant's or third person's computer and/or its contents, related to or resulting from the Contest. Sponsor reserves the right to terminate, suspend or modify the Contest if, at its sole discretion, it determines that for any reason the Contest is not capable of running as originally planned, or fraud, technical failures, printing, mailing or distribution errors, or any other unanticipated causes or occurrences have compromised the fairness or integrity of the Contest. In the event the Contest is terminated prior to the stated end date, Sponsor reserves the right to award all prizes in a random drawing from among all eligible Entries received as of the date of termination. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sponsor, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of California, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than California. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

7. Release. By entering the Contest, contestants release zafu, any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

8. Sponsor Information. The Jeans 911 Photo Contest is sponsored by Archetype Solutions, Inc., d/b/a zafu, (“Sponsor” or “zafu”) whose decisions regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
